Sen. Chuck Grassley, R-Iowa, this week released more FBI files related to the surveillance of Republican organizations and persons by then-special counsel Jack Smith. The new information provided by Grassley, chairman of the Senate Judiciary Committee, also prompted a renewed call for Chief Judge James Boasberg of the U.S. District Court for the District of Columbia to be impeached.
In particular, Sen. Ted Cruz, R-Texas, denounced the federal judge for signing a gag order preventing AT&T from letting the Texas lawmaker know that his cellphone records had been sought by Smith for at least a year.
“If a judge signs an order reaching a factual conclusion for which there is zero evidence whatsoever, that judge is abusing his power,” Cruz said at the press conference, adding:
“I am right now calling on the House of Representatives to impeach Judge Boasberg.”
Smith and his team issued 197 subpoenas as part of his investigation into President Donald Trump related to his challenges of the fairness of the 2020 presidential election and the handling of classified documents. The subpoenas covered information related to media communications with CBS, Fox News, and Newsmax and White House officials such as Stephen Miller and Jared Kushner, among many others.
Grassley had previously released information indicating that the FBI under President Joe Biden had sought the tolling data—encompassing the time, duration, and call numbers—from Jan. 4 through Jan. 7, 2021, of several Republican senators.
Smith ultimately filed to have his charges dropped after Trump won reelection in November 2024. According to Grassley’s office, Smith’s investigation began at the FBI during the Biden administration with the codename “Arctic Frost.”
“Arctic Frost was the vehicle by which partisan FBI agents and DOJ prosecutors could improperly investigate the entire Republican political apparatus. Contrary to what [Jack] Smith has said publicly, this was clearly a fishing expedition,” the Iowa senator said at the press conference.
The subpoenas, sent to 34 separate people and 163 businesses, were given to the Senate Judiciary chairman through whistleblower disclosures.
“Judge James E. Boasberg, that radical leftist judge who is out of control, who has been issuing nationwide injunctions one after the other trying to stop President Trump from carrying out his mandate for the voters,” Cruz said, alluding to complaints over the federal judge’s handling of the Trump administration’s efforts to deport illegal aliens.

In March, Boasberg blocked the president’s employment of wartime powers to deport suspected Tren de Aragua gang members to an El Salvadoran prison. That court order came despite calls for the judge to recuse himself over a potential conflict of interest.
“Given that [Boasberg’s] daughter works directly for an organization that supports illegal aliens, opposes deportation of aliens, and has voiced its support for Boasberg’s action in this very case, the impartiality of his judgment is obviously open to be reasonably questioned,” Hans von Spakovsky, a senior legal fellow at The Heritage Foundation, explained to the Daily Caller News Foundation.
